MarkaSouq is an online marketplace that allows registered users to sell and buy products and services from a variety of brands. The following terms and conditions apply to all sellers using the MarkaSouq platform to sell products and services. By using the MarkaSouq platform, you agree to these terms and conditions.
Eligibility
- • Sellers must be at least 18 years old and legally eligible to sell products as per regional laws.
- • MarkaSouq reserves the right to refuse access at its sole discretion.
Listing and Selling
- • Sellers are responsible for accurate and complete product/service descriptions (size, color, condition, shipping).
- • MarkaSouq can remove inappropriate or violating listings.
- • Listings and sales must comply with all applicable laws and regulations.
- • Prices must be accurate and include applicable taxes and shipping charges.
Payment
- • MarkaSouq uses a third-party payment provider.
- • Users agree to use this provider for all platform transactions.
- • Sellers are responsible for calculating and collecting applicable taxes.
Shipping
- • Sellers are responsible for timely shipping and providing tracking information.
- • Products must comply with all shipping laws and regulations, including hazardous materials.
Returns and Refunds
- • Sellers are responsible for handling returns/refunds per MarkaSouq's policy and applicable laws.
- • Sellers must respond to buyer inquiries within a reasonable time.
Intellectual Property
- • Sellers warrant they have the right to sell products/services and that these do not infringe on third-party IP rights.
- • Sellers agree to indemnify MarkaSouq from IP infringement claims.
Limitation of Liability
- • MarkaSouq is not responsible for damages/losses from platform use or product/service sales.
User Account
- • Sellers must create an account with accurate and complete information.
- • Sellers are responsible for account confidentiality and all activities under their account.
- • Sellers must notify MarkaSouq of unauthorized activity or security breaches.
- • Sellers must ensure products/services meet high quality standards and are defect-free.
- • Sellers must promptly address and resolve buyer problems with products/services.
Marketing and Promotion
- • MarkaSouq may use seller's name and logo for marketing with prior written consent.
Feedback
- • MarkaSouq encourages buyer feedback.
- • Sellers agree to respond promptly and professionally to feedback.
Data Privacy
- • MarkaSouq may collect, use, and process personal data per its Privacy Policy.
Changes to Terms and Conditions
- • MarkaSouq reserves the right to change terms and conditions at any time without prior notice.
Governing Law
- • Terms are governed by laws of the United Arab Emirates and applicable federal laws.
Dispute Resolution
- • Disputes will be resolved through arbitration per Dubai International Arbitration Center rules.
Entire Agreement
- • Terms constitute the entire agreement, superseding prior agreements.
Severability
- • If any provision is invalid, remaining provisions remain in effect.
Assignment
- • Users may not assign rights/obligations without MarkaSouq's written consent.
Waiver
- • Failure to enforce a provision does not waive that or any other provision.
